February 17, 2009
LONG BEACH, Miss. — One year after ATM manufacturer Triton Systems of Delaware requested a preliminary injunction against Global Cash Services, a statement released by Triton says the two companies have settled. The injunction sought to keep GCS, a consulting firm, from assisting ATM providers and deployers with ATM products or services.
The injunction was granted by a Mississippi court in Julybut amendedin August to allow GCS to work withGRG Banking Equipment Co. Ltd. on ventures that did not use Triton trade secrets. GCS, which was founded by former Triton employees, was working with China-based GRG on GRG's U.S. operations.
Triton sued GCS in February 2008, alleging the company used proprietary Triton ATM information in its dealings with GRG.Former Triton president Brian Kett and former Triton engineer Bill Jackson were both named in the suit.
The case was expected to go to trial in early 2009.
In a statement issued today, Triton says the "lawsuit has been resolved on mutually agreeable terms" and "Kett and Jackson are free to work in the ATM industry."
Terms of the agreement are confidential. Triton and GCS would not comment on the settlement.
