Just when the U.S. payments industry was getting close to a common solution to its unusual quandary of how to enable network choice for EMV transactions, along comes U.S. District Court Judge Richard Leon's ruling, blowing up the Fed's solution — implemented last October — for Durbin fee cap and transaction routing. And suddenly, it might not be just two networks anymore. But no one will be sure of this until the case winds its way through the appeals process — which could go all the way to the Supreme Court. And beyond that, there's the additional time it will take to Implement whatever final solution the Fed deploys. In the meantime, what to do about EMV migration?
