CPI fails to invalidate Gemalto EMV chip card patent claims

The U.S. Patent and Trademark Office has denied CPI challenges to the validity of several claims of U.S. Patent No. 5,944,833, which is owned by Gemalto and widely used in protecting contact and contactless EMV chip card security.

Gemalto patents describe fundamental measures used in EMV cards around the world to prevent security breaches and card cloning, the company said in a press release.

Gemalto asserted the 833 patent and U.S. Patent No. 6,786,418 in complaints filed against CPI Card Group Inc. in U.S. District Court for the District of Colorado. The court had put the case on hold while the patent office completed a review of the 833 patent.

On Nov. 10, the USPTO denied CPI’s challenge to the validity of a number of claims of the patent, clearing the way for the case to resume.

"I am pleased that the U.S. Patent and Trademark Office decided in favor of Gemalto after a thorough examination,” said Bertrand Knopf, senior vice president of secure transactions for North America at Gemalto. "Gemalto expects its competitors respect Gemalto patents.”

The Gemalto intellectual property portfolio includes 4,300 patents and patent applications representing approximately 1,200 patent families.
