The class action suit against Hope Community Credit Union in Jackson, Miss., is moving forward after a federal court in Tennessee on Tuesday certified the action status. Plaintiff Vicki Campbell filed the suit in U.S. District Court for the Western District of Tennessee, alleging that the credit union's Memphis, Tenn., branch violated the Electronic Funds Transfer Act by failing to provide a fee disclosure at three of its ATMs, according to cuna.org.
Campbell is seeking to represent "as many as several thousand" consumers who initiated transactions at the ATMs, according to court documents filed Tuesday. The court established three subclasses for the suit, one for each of the ATMs involved in the case.
