ATM fee placard litigation: It ain't over 'til it's over

In a reminder that EFTA isn't quite dead yet, Massachusetts Attorney General Martha Coakley said on Monday that Merrimak ATM Group LLC will pay $50,000 to settle a case involving allegations of missing fee placards at some of its ATMs.

The Boston Globe reported that the IAD, which operates several hundred off-premises ATMs in the Commonwealth of Massachusetts, also agreed to change its disclosure practices in accordance with Massachusetts requirements.

The IAD agreed to the filing of an "assurance of discontinuance" in order to resolve the case, but stated in the document, "Merrimak enters into this AOD for settlement purposes only and neither admits nor denies the . . . allegations."
