US ATM industry faces another year of legislative challenges

In late 2012, the ATM Industry Association achieved one of our most significant legislative successes — the elimination of the federal dual fee signage requirements that were part of Reg E. ATMIA was a key element of an industry coalition that made this happen.

We couldn't have achieved this victory without funding provided in part by the industry through contributions to the U.S. Defense Fund. The Defense Fund addressed important strategic issues that fall outside the general benefits of membership, and it is vital to protecting the health and vitality of our industry.

In 2014, we face another difficult year of industry challenges and need your support.

On the federal level, ATMIA has begun a multi-year effort to change Fed rules on ATM transaction routing choice.  Regardless of what happens in the Federal Reserve Board appeals case on Durbin rules, there will be rule changes. Now is the time, before EMV is fully implemented, to aggressively advocate for ATM operator routing choice similar to that afforded to merchants.

On the state level — in your own back yard — ATMIA will take on additional key issues. These include:

  • state laws that restrict or inhibit the deployment of ATMs by independent operators.  With ATMIA support and member effort, a bill eliminating such restrictions was recently passed in Tennessee;
  • a move by at least one state to classify surcharge revenue sharing as rent and, as such, subject to state sales tax;
  • new restrictions on TANF/EBT card use at the ATM by the states as they implement 2012 federal guidelines; and
  • serial plaintiffs who file ADA cases for the purpose of generating legal fees.
