Lawsuits stemming from the new ADA guidelines for ATMs continue to mount. Most recently, 19 FIs have been sued by a blind Texas woman for allegedly failing to meet ADA requirements.
According to an American Banker article, plaintiff Victoria Gilkerson is represented by a "prolific" tort lawyer from the Pittsburgh area, R. Bruce Carlson. His other clients include Robert Jahoda, a legally blind Pennsylvania man who has filed at least 20 ADA-related suits since the new requirements went into effect on March 15. Carlson also has filed an additional five suits on behalf of another client.
Several of the Jahoda suits have been settled. In each case, the FI agreed to bring non-compliant ATMs in line with the standards without having to pay damages. However, they have had to pay "tens of thousands" in legal fees to Carlson.
