According to the Las Vegas Review-Journal, a Los Angeles-area man spent time in Las Vegas searching for ATMs that didn't display surcharge fee stickers and became the lead plaintiff in cases against 17 nonbank operators.
Attorney Mark Henness said that Thomas Chayra was referred to his law firm by other law firms in Los Angeles and Houston. According to the article, Henness said that Chayra saw how other people across the country were making money from sticker fee disclosure lawsuits.
He is said to have been seen taking photos of machines in various locations around Las Vegas.
Regulation E requires a notice on or near the ATM, as well as on the screen, alerting customers of associated surcharge fees before completing a transaction.
"Our concern is with the financial institutions," Henness said. "But we have to sue [the outlets] to know who the institutions are."
