PHILADELPHIA -- Joseph Scarpa, owner of Allegro Pizza in Philadelphia, and Barbara Isan, owner of K'Ching Inc. in Lighthouse Point, Fla., have taken the first step in what they hope will be the recovery of some of the monies they contend that Credit Card Center owes to at least 11,000 merchants across the U.S.
The two filed a class-action complaint against the financially strapped ISO on May 25, alleging breach of contract, among other charges.
The complaint contends that CCC stopped paying surcharge revenues that it agreed to pay merchants, as well as monthly ATM advertising revenues and processing revenues.
Bryan Clobes of Miller, Faucher and Cafferty LLP, one of two Philadelphia firms representing the plaintiffs, said that while the suit currently only involves CCC, that could change as the case unfolds.
"We'll initiate discovery soon, and we intend to explore all of CCC's business relationships, including their dealings with leasing companies," Clobes said.
