Judge will hear motions to dismiss class-action suit in Heartland data-breach case

Bank Info Security reports preliminary legal hearings have begun in the class-action lawsuit against Heartland Payment Systems, which was breached in 2008, leading to the compromise of 130 million credit and debit cards. More than 30 financial institutions in 22 states are part of the suit. Heartland has reportedly filed a motion with the Court to ask that all discovery be stayed until after a ruling is made on Heartland's motion to dismiss. Heartland must file its motion to dismiss by Oct. 23. Briefing on the motion will be completed by mid-December and it is expected to be argued in early January. Until the Court issues its ruling, no real decision is expected regarding the litigation.
